XLII Concurso Nacional de Fotografía Junta Mayor Hermandades Semana Santa Gandía.
Participantes:
Podrán concurrir a este Concurso todas las personas que lo deseen, españoles o de cualquier otra nacionalidad, sean profesionales o aficionados, siempre que sus trabajos se ajusten a las bases del mismo.
Participants:
All persons who wish to do so, Spanish or of any other nationality, whether professionals or amateurs, may participate in this Contest, provided that their work conforms to its rules.
Temática:
Se establecen dos modalidades:
- Aspectos de la Semana Santa. Fotografías donde se pueda apreciar claramente que se trata de personas, paisajes, obras culturales y/o artísticas de la Semana Santa.
- Tema libre. Fotografías entendidas libremente por su autor y que tengan como referencia cualquier aspecto del ser humano, la riqueza paisajística, cultural, artística, etc.…
En todas las modalidades se debe indicar el lugar y año en que la fotografía ha sido tomada.
Theme:
Two modalities are established:
- A) Aspects of Holy Week. Photographs where it can be clearly seen that they are people, landscapes, cultural and/or artistic works of Holy Week.
- B) Free theme. Photographs freely understood by their author and that have as a reference any aspect of the human being, the rich landscape, culture, art, etc.…
In all modalities, the place and year in which the photograph was taken must be indicated.
Características de las fotografías.
- Las obras deberán ser necesariamente originales, no habiendo sido premiadas en este u otros concursos o certámenes en sus ediciones anteriores.
- Cada participante podrá presentar hasta un máximo de cinco fotografías en las modalidades A y B. El contenido de las mismas necesariamente estará relacionado con el tema del concurso.
- Las fotografías deberán ser propiedad del autor que las presente al certamen y deben venir acompañadas del título de la obra.
Characteristics of the photographs.
- The works must necessarily be original, not having been awarded in this or other contests or events in their previous editions.
- Each participant may submit up to a maximum of five photographs in modes A and B. Their content will necessarily be related to the theme of the contest.
- The photographs must be the property of the author who submits them to the contestand must be accompanied by the title of the work.
Presentación y envío:
Las fotografías deberán presentarse en formato JPEG, con un peso entre 1 y 2 Mb a través del formulario de inscripción habilitado en la página web www.semanasantagandia.es, junto con el Documento de cesión en favor de la JMHHSS de Gandia de la obra en caso de ser seleccionada para su exposición.

Thephotographs must besubmitted in JPEG format, with a weightbetween 1 and 2 Mb throughtheregistrationformenabledonthe website www.semanasantagandia.es, togetherwiththeAssignmentDocument in favor ofthe JMHHSS ofGandíaofthework in case ofbeingselected for exhibition.
Fecha de presentación:
La fecha límite de inscripción y presentación de obras será el día28 de diciembre de 2023, fecha en la que el jurado del concurso realizará una preselección no superior al 50% de las obras inscritas entre las cuales saldrán las obras premiadas.
Asimismo,se realizaráuna selección de 70 obras de entre las preseleccionadas para la exposición.
Date of presentation:
The deadline for registrationandpresentationofworkswillbeDecember 28, 2022, the date onwhichthecontestjurywillmake apre-selectionof no more than 50% oftheregisteredworks, amongwhichthewinningworkswill come out.

Jurado:
El jurado será designado por la JMHHSSG entre personas competentes en el arte fotográfico y/o artístico, y su nombramiento se hará públicoal finalizar el plazo de admisión.
El fallo del jurado será hecho público el día13 de enero de 2024 y será inapelable.
Se dará publicidad del fallo mediante comunicación escrita o telefónica a los participantes premiados.
El Jurado no podrádeclarar ningún premio desierto de los que se establecen en el apartado siguiente y se reservará el derecho de retirar el premio de alguna obra que incurriera en prácticas de mala fe a criterio del jurado. Del mismo modo, ninguna obra podráacceder a dos premios distintos dentro del concurso.
Jury:
The jury will be appointed by the JMHHSSG from among competent people in photographic and/or artistic art, and their appointment will be made public at the end of the admission period.
Thejury’sdecisionwillbemadepubliconJanuary 13, 2024andwillbe final.
The ruling will be publicized by written or telephone communication to the winning participants.
The Jury will not be able to declare any void prize of those established in the following section and will reserve the right to withdraw the prize from any work that incurs bad faith practices at the discretion of the jury. In the same way, no work will be able to access two different prizes within the contest.

La aceptación del premio conlleva la obligatoriedad por parte del autor premiado de remitir la obra firmada (en su parte posterior) y certificada a la organización, en tamaño libre no inferior a 24×30 cm y montado sobre paspartú rígido de 40×50 cm en un plazo máximo de 10 días desde el fallo del jurado y su comunicación al autor.
En el caso de fotografías premiadas, será obligatorio, además, acompañar la siguiente documentación:
– Currículo fotográfico profesional.
– Fotocopia Documento Nacional de Identidad legible.
La entrega de premios de las obras seleccionadas y premiadas se realizará en acto público el día27de enero de 2024 en la Ciudad de Gandia.
The acceptance of the award entails the obligation on the part of the award-winning author to send the signed work (on the back) and certified to the organization, in free size no less than 24×30 cm and mounted on a 40×50 cm rigid passe-partout in a maximum period of 10 days from the jury’s decision and its communication to the author.

Las fotografías premiadas y derechos sobre las mismas:
Las obras premiadas quedarán en propiedad de la Junta Mayor de Hermandades de Semana Santa de Gandia, pasando a formar parte de sus fondos artísticos, que se reserva todos los derechos sobre las mismas y podráutilizarlas posteriormente por tiempo ilimitado con fines culturales, artísticos o publicitarios, citando siempre el nombre del autor; ateniéndose, en todo caso, a lo que dispone la Ley de Propiedad Intelectual.
Cada autor tiene el derecho sobre las obras inscritas en el concurso, pero cede a la JMHHSSG, sin ninguna remuneración, los derechos de reproducción, exposición, publicación y comunicación al público, de cualquier manera y sin excepción, para sus obras que participan en el Concurso.
Los/las concursantes se responsabilizarán de que no existan derechos a terceros sobre sus obras, responden de la autoría y la originalidad de su obra y del ejercicio pacífico de los derechos que ostentan sobre la misma. Así mismo, garantizan y se responsabilizan ante la JMHHSSG del cumplimiento de las disposiciones en materia de propiedad intelectual y de derechos de imagen sobre las fotografías presentadas, declarando que su difusión y/o reproducción en el marco del concurso y de estas bases no lesionan ni perjudican a terceros y asumen personalmente cualquier responsabilidad que de las mismas pudiera derivarse. La JMHHSSG se compromete, por su parte, a indicar el nombre del autor cada vez quesuobra sea reproducida.
Los /las concursantes, autores de las fotografías y titulares de derechos sobre éstas, cuyas fotografías resulten premiadas y/o seleccionadas para ser expuestas, deben otorgar, en un documento escrito, que cedan de manera voluntaria y por tiempo ilimitado a la JMHHSSG los derechos de uso de las obras de acuerdo con las presentes bases para la promoción del concurso. Si hubieran de ser utilizadas fuera de la promoción del concurso se solicitaría el permiso del autor.
Los autores premiados se comprometen a recoger los premios en el acto de inauguración de Exposición que con motivo del certamen se realizará en la Ciudad de Gandia y cuya fecha se comunicará a los premiados. En el caso excepcional y justificado de no poder asistir al acto, el premiado podránombrar a una persona en su lugar para recoger el premio.
The winning photographs and rights over them:
The winning works will remain the property of the Mayor Board of Brotherhoods of Holy Week in Gandia, becoming part of its artistic collections, which reserves all rights over them and may subsequently use them for an unlimited time for cultural, artistic or advertising purposes. , always citing the author’s name; adhering, in any case, to the provisions of the Intellectual Property Law.
Each author has the right to the works entered in the contest, but assigns to the JMHHSSG, without any remuneration, the rights of reproduction, exhibition, publication and communication to the public, in any way and without exception, for their works that participate in the contest. Contest.
The contestants will be responsible for the absence of rights to third parties over their works, they are responsible for the authorship and originality of their work and for the peaceful exercise of the rights they hold over it. Likewise, they guarantee and are responsible before the JMHHSSG for compliance with the provisions regarding intellectual property and image rights on the photographs presented, declaring that their dissemination and/or reproduction within the framework of the contest and these bases do not harm or harm third parties and personally assume any liability that may arise from them. The JMHHSSG undertakes, for its part, to indicate the name of the author wheneverhis work is reproduced.
The contestants, authors of the photographs and holders of rights over them, whose photographs are awarded and/or selected to be exhibited, must grant, in a written document, that they voluntarily assign and for an unlimited time to the JMHHSSG the rights of use of the works in accordance with these bases for the promotion of the contest. If they were to be used outside the promotion of the contest, the authors´s permission would be requested.
The award-winning authors undertake to collect the prizes at the opening ceremony of the Exhibition that will be held in the City of Gandia on the occasion of the contest and the date of which will be communicated to the winners. In the exceptional and justified case of not being able to attend the event, the winner may appoint a person in his place to collect the award.
Protección de datos:
Los participantes en el presente concurso aceptan y dan su consentimiento para que los datos personales exigidos para la inscripción en el concurso sean incorporados a una base de datos del concurso de fotografía cuyo responsable es la JMHHSS de Gandia y con la finalidad de desarrollar el concurso de fotografía anual, conforme indica la legislación vigente en Protección de Datos.
La entrega de los datos personales exigidos para la inscripción en el concurso es obligatoria para poder llevar a cabo la misma.
De igual modo, JMHHSSG ha adoptado los niveles de seguridad de protección de los Datos Personales requeridos, y procurará instalar aquellos otros medios y medidas técnicas adicionales a su alcance para evitar la pérdida, mal uso, alteración, acceso no autorizado y robo de los Datos Personales facilitados por los participantes del concurso.
Al legitimar por el consentimiento, los participantes consienten expresamente al rellenar el formulario de inscripción al Concurso, que JMHHSSG pueda utilizar tales datos para finalidades promocionales sobre sus actividades, incluyendo el envío de tales comunicaciones promocionales por medios electrónicos en los términos previstos en el art. 21 de la Ley 34/2002, de Servicios de la Sociedad de la Información y comercio electrónico. Estos datos se conservarán mientras no se solicite la supresión de los mismos.
En todo caso, inscribiéndose en el Concurso, los participantes autorizan a JMHHSSG a enviarles comunicaciones relacionadas con la gestión del Concurso utilizando los datos personales de contacto facilitados por los mismos.
Los concursantes tienen derechos reconocidos y podrán ejercitar gratuitamente los derechos de acceso, supresión, rectificación, oposición, limitación al tratamiento y portabilidad de los datos en relación con sus datos personales dirigiéndose por escrito a JMHHSSG, en la siguiente dirección: Calle Abad Solá, nº 108- 110 de Gandia 46701, (Valencia), España, acompañando su DNI, o por correo electrónico dirigido a la dirección cultura@semanasantagadia.es
Data Protection:

Garantías y observaciones.
Derechos de Imagen:
Todos los Participantes autorizan a la JMHHSSG sin límite de tiempo y lugar a reproducir, utilizar y difundir las fotografías que presenten a concurso, sus nombres y apellidos en cualquier actividad publicitaria o promocional que esté relacionada con el Concurso Nacional de Fotografía sin que dicha difusión les confiera derecho de remuneración o beneficio alguno.
Con el fin de que se respeten los derechos de terceros y de evitar situaciones anómalas en el desarrollo del concurso, la JMHHSSG comunica que:
– La persona que inscriba su trabajo en este concurso será la responsable legal del contenido del mismo. Las fotos no pueden contener material ilícito, ni pornográfico, ni que atente a cualquier derecho de tercero, especialmente aquellos relativos a derechos de propiedad intelectual, al honor, la imagen o la infancia.
– El Concurso y la JMHHSSG declinan toda responsabilidad legal sobre los trabajos y su contenido. Asimismo, la participación supone la cesión gratuita de derechos de reproducción y comunicación pública sobre las fotografías e imágenes a favor de la JMHHSSG, sin limitación territorial o temporal sobre las mismas. También supone una cesión gratuita en lasmismas condiciones, del derecho de modificar o adaptar parcialmente la imagen para su inclusión en cualquier tipo de material o soporte publicitario o propio de la JMHHSSG, sin derecho en todo caso, a contraprestación alguna.
– La explotación de la fotografía podrá realizarse por cualquier medio y utilizando cualquier método, ya sea a través de internet, exposiciones fotográficas, revistas, libros u otros materiales publicitarios digitales o análogos.
– La organización se reserva igualmente el derecho a no utilizar las fotografías.
– El Participante renuncia expresamente a firmar y/o colocar su nombre en cualquier realización de la Fotografía. No obstante, la JMHHSSG podrá utilizar el nombre y la imagen del participante en cualquier comunicación en relación con la fotografía y durante el desarrollo del presente concurso, y en particular notas de prensa, prensa escrita, catálogos, libros y folletos.
Todas las fotografías presentadas tendrán que estar libres de derechos a terceros. Todas aquellas fotografías que no cumplan alguno de los requisitos establecidos en las presentes Bases quedarán descalificadas.
Guarantees and observations.
Image rights:
All Participants authorize the JMHHSSG without limit of time and place to reproduce, use and disseminate the photographs they submit to the contest, their names and surnames in any advertising or promotional activity that is related to the National Photography Contest without such dissemination confers the right to any remuneration or benefit.
In order to respect the rights of third parties and to avoid anomalous situations in the development of the contest, the JMHHSSG communicates that:
– The person who registers her work in this contest will be legally responsible for its content. The photos may not contain illicit or pornographic material, or that violates any third party right, especially those related to intellectual property rights, honour, image or childhood.
– The Contest and the JMHHSSG decline all legal responsibility for the works and their content. Likewise, participation implies the free transfer of reproduction and public communication rights over the photographs and images in favour of the JMHHSSG, without territorial or temporal limitation on them. It also supposes a free cession in the
same conditions, of the right to modify or partially adapt the image for its inclusion in any type of advertising material or support or of the JMHHSSG, without the right in any case, to any consideration.
– The exploitation of the photograph may be carried out by any means and using any method, whether through the internet, photographic exhibitions, magazines, books or other digital or similar advertising materials.
– The organization also reserves the right not to use the photographs.
– The Participant expressly waives to sign and / or place her name in any realization of the Photograph. However, the JMHHSSG may use the name and image of the participant in any communication related to the photo and during the development of this contest, and in particular press releases, written press, catalogues, books and brochures.
All the photographs presented must be free of rights to third parties. All those photographs that do not meet any of the requirements established in these Bases will be disqualified.
Aceptación de las bases:
La participación en este concurso supone la aceptación de estas bases en su totalidad.
La JMHHSSG queda facultada para resolver cualquier contingencia no prevista en las Bases del presente Concurso, de acuerdo con su mejor criterio. Así mismo, JMHHSSG se reserva el derecho de modificar las condiciones del presente concurso en cualquier momento dentro del plazo de participación en el concurso, e incluso de anularlo o dejarlo sin efecto, siempre que concurra causa justificada para ello.
En todo caso, se compromete a comunicar a través de la web de la JMHHSSG las bases modificadas del concurso, o en su caso, la anulación del concurso en su conjunto, de forma que todos los participantes tengan acceso a dicha información.
En el caso de que el Jurado del Concurso decidiera retirar algún premio, siempre con causa justificada, el concursante premiado deberá, en el plazo máximo de 15 días desde la publicación de la retirada del mismo, devolver a la JUMHHSS de Gandia la totalidad del premio (tanto el trofeo como la cuantía económica). En el caso de que esto no sucediera, la organización se reserva el derecho de publicitar dicha negativa en cuantos medios considere necesario para su correcta difusión, así como se vetaría al concursante para futuras participaciones del concurso.
Acceptance of the bases:
Participation in this contest implies acceptance of these rules in their entirety.
The JMHHSSG is empowered to resolve any contingency not foreseen in the Bases of this Contest, according to its best criteria. Likewise, JMHHSSG reserves the right to modify the conditions of this contest at any time within the period of participation in the contest, and even to cancel it or leave it without effect, provided that there is just cause for it.
In any case, you agree to communicate through the JMHHSSG website the modified rules of the contest, or where appropriate, the cancellation of the contest as a whole, so that all participants have access to said information.
In the event that the Contest Jury decides to withdraw a prize, always with just cause, the winning contestant must, within a maximum period of 15 days from the publication of the withdrawal of the same, return the entire prize to the JUMHHSS of Gandia. (both the trophy and the economic amount). In the event that this does not happen, the organization reserves the right to publicize said refusal in as many media as it deems necessary for its correct dissemination, as well as the contestant being banned from future participation in the contest.
Legislación y jurisdicción aplicable:
Las presentes bases se regulan por la legislación española. Para el conocimiento de cualquier tipo de litigio que pudiera plantearse en cuanto a la interpretación o aplicación de las presentes bases, tanto JMHSSG como los participantes en este concurso, se someten expresamente a la jurisdicción española y a la competencia de los Juzgados y Tribunales de la ciudad de Gandia y superiores jerárquicos, con renuncia expresa a cualquier fuero que les correspondiera.
Applicable law and jurisdiction:
These bases are regulated by Spanish legislation, For the knowledge of any type of litigation that could arise regarding the interpretation or application of these bases, both JMHSSG and the participants in this contest, expressly submit to the Spanish jurisdiction and to the jurisdiction of the Courts and Tribunals of the city of Gandia and hierarchical superiors, expressly renouncing any jurisdiction that may correspond to them.
